Full Privacy Policy

The document below is the full policy text maintained in the State Capital Mortgage policy registry.

1. Who we are

Cap Funds LLC DBA State Capital Mortgage (“SCM,” “we,” “us”) is a Nevada-licensed mortgage broker doing business as State Capital Mortgage, NMLS ID 2233984, Nevada Department of Business and Industry License #5478. Our office is located at 7465 West Lake Mead Boulevard, Suite 100, #119, Las Vegas, NV 89128.

2. Information we collect

When you submit a form on this site (Apply, Send Scenario, Contact, Join the Team / Careers, or Request a Callback) or contact us by phone or email, we collect:

  • Identity & contact information. Name, email address, phone number, mailing or property address.
  • Loan-scenario information you provide. Loan goal (purchase, refinance, equity), property type, target loan amount, estimated income, employment, occupancy, and similar planning details.
  • Recruiting information you provide. Work background, licensing status, resume or LinkedIn URL, and notes you submit through a Join the Team / Careers form.
  • Submission metadata. Timestamp of submission, the page you submitted from, your user-agent string, and a one-way hashed representation of your IP address used for abuse prevention. We do not store the raw IP.
  • Consent records. Confirmation that you accepted this Privacy Policy and our Terms & Conditions at the time of submission.

We do not request government identifiers (SSN, ITIN, driver’s license number) through this website. Those are collected only inside our secure loan origination system after a licensed loan officer engages with you.

3. How we use your information

  • To respond to your inquiry and prepare a personalized scenario review.
  • To respond to recruiting or employment-related inquiries.
  • To deliver required regulatory and compliance notices, including this Privacy Policy and our Terms.
  • To meet our recordkeeping obligations under federal and Nevada state law, including those governing licensed mortgage brokers.
  • To detect and prevent fraud, abuse, and unauthorized use of the website.

4. Sharing

We share information only when one of the following applies:

  • Service providers. Vendors that host our infrastructure, deliver our transactional email, and operate our loan origination system, all under written confidentiality and security obligations.
  • Lender partners. When you authorize us to shop your loan, we share what is reasonably necessary with the wholesale lender(s) you have approved.
  • Legal & regulatory. When required by law, subpoena, or to comply with state or federal regulators.

We do not sell your personal information, and we do not share it with third-party marketers.

5. Retention

We retain inquiry records for as long as required by Nevada and federal mortgage broker recordkeeping rules, and only as long as needed to fulfill the purposes above. Audit logs of consent and policy delivery are kept on an append-only basis to demonstrate compliance.

6. Your choices

  • Access & correction. Email office@scmnv.com to request a copy or correction of the information we hold about you.
  • Marketing opt-out. Required compliance and transactional communications (such as this Privacy Policy notice and responses to your inquiry) are sent regardless of opt-out, but you can opt out of any non-required marketing email at any time by replying with “UNSUBSCRIBE”.
  • Deletion. You may request deletion of your records subject to our regulatory retention obligations.

7. Security

We use TLS in transit, hashed storage of any IP-style identifiers, encrypted database storage at rest with our hosting providers, and least-privilege access for the small team that handles inquiries.

8. Children

This website is not directed to children under 16, and we do not knowingly collect information from them.

9. Updates

We will email you each year on the anniversary of your initial inquiry to confirm our current Privacy Policy. We will also email you whenever we publish a substantive update.
